
The Office of the Comptroller of Puerto Rico issued a qualified opinion on the fiscal operations of the Municipality of Juncos. A qualified opinion is issued when the noncompliances, individually or in the aggregate, are significant but not pervasive.
The Report reveals that Juncos paid $32,803 in fines, penalties, interest, and surcharges for sending late the withholdings and contributions to the Federal Social Security and the Department of the Treasury. The Municipality also paid a $1,000 fine to the Environmental Quality Board because it did not have the Operating Permit for the Underground Storage Tank System for fuel or the liability policy required for $1 million.
The three-finding audit notes that goods and services were acquired for $16,174 without obtaining quotes from at least three suppliers representative in the market. This situation prevented the Municipality from having available several alternatives to select the best offers. A similar finding was noted in Audit Report M-15-34 of 2015.
Contrary to Act 81-1991 of Autonomous Municipalities, the mayor reached a settlement agreement of a civil lawsuit without obtaining the consent of the Municipal Legislature. This situation did not allow the Legislature to pass judgment on the correctness and reasonableness of the amount to be paid or of the stipulated agreement.
The Report comments that as of June 30, 2017, 17 civil lawsuits against the Municipality for $4.7 million were pending resolution by the courts.
