
The Office of the Comptroller of Puerto Rico issued a qualified opinion on the fiscal operations of the Municipality of Camuy. A qualified opinion is issued when the instances of noncompliance, individually or in the aggregate, are significant but not pervasive.
The Report reveals that the Municipality granted construction contracts without the permits required by the Permit Management Office (OGPe), in 50% of the works examined. In addition, contracts were granted without requiring contractors to provide evidence of having obtained the policies of the State Insurance Fund Corporation, the public liability policies and without the contractors presenting the bonds to guarantee the development of the works (performance bond) and the payment of labor (payment bond).
These situations, contrary to the law and regulations in effect, did not allow the OGPe to exercise its regulatory function, fostered the disbursement of $14,080 to the contractors without evidence to justify the payments, and could have caused the Municipality to have to respond for the contractor, had any accident occurred.
The audit of two findings also points out that $2,248 were disbursed for services not contemplated in the contract for the supervision of the improvements to the Daniel “La Cobra” Jiménez court. This situation is attributed to the fact that services requested by the mayor were not included in the contract.
The Report recommends that the director of the Office of Management and Budget ensure that the Municipality complies with the Corrective Action Plan, and that the mayor obtain the construction permits prior to contracting works.
