The Office of the Comptroller of Puerto Rico issued an adverse opinion on the fiscal operations of the Manatí–Dorado Local Workforce Development Area. The tests performed and the evidence in the Office of the Comptroller's possession revealed that the operations were not carried out in all significant respects, in accordance with applicable law and regulations.
The Report reveals that a then special assistant of the Manatí-Dorado ALDL issued a letter with a false job offer for his brother, with the official logo and email of the Local Area. The former official signed the letter as director of the Information Systems Department, a position that does not exist in the Classification and Compensation Plan in the Trust Service. His brother presented this letter to his private employer, with the purpose of obtaining a counteroffer of employment and salary.
The one-finding audit also points out that the executive director was aware of this situation, but did not impose disciplinary measures on the then special assistant, but rather promoted him to occupy on an interim basis the position of executive director, from 2016 to 2017.
This possible commission of a crime was notified to the then Secretary of Justice and to the then Executive Director of the Office of Government Ethics of Puerto Rico on April 12, 2019, so that they take the corresponding measures. At present, the investigation continues.
These situations could constitute the crimes of ideological falsehood, and possession and transfer of falsified documents, as established by Act 146-2012, the Penal Code of Puerto Rico.
