The Office of the Comptroller of Puerto Rico issued a qualified opinion of Hormigueros' fiscal operations related to collections, fund transfers, bank reconciliations, as well as the legality of the purchase of goods and services, among others. A qualified opinion is issued when individual or combined noncompliance is significant, but not pervasive.
The single-finding Report reveals that unauthorized persons provided refrigeration services for the Municipality of Hormigueros. These maintenance and repair services for air conditioners were formalized with the corporation that won the bid, between 2017 and 2018 through two contracts and three amendments for $71,780.
The Examining Board of the Department of State, and the Association of Refrigeration Technicians, certified that the vice president of the contracted corporation and two of its employees who performed work for the Municipality did not hold a license from the Department of State, nor are they active members of the Association of Refrigeration Technicians.
These situations resulted in unauthorized persons providing services for which there is no certainty that they complied with the laws and certifications of the profession. The Report recommends that the president of the Association of Refrigeration and Air Conditioning Technicians of Puerto Rico consider the finding and take the pertinent measures.
The audit comments that, as of December 31, 2019, five civil lawsuits for $13,098,106 were pending resolution by the courts. In addition, a case claiming $175,000 for wrongful dismissal and discrimination was pending resolution before the Public Service Appeals Commission. The Hormigueros report covers the period from July 1, 2017 to December 31, 2019.
