The Office of the Comptroller of Puerto Rico issued a qualified opinion on the fiscal operations of the Municipality of Comerío. A qualified opinion is issued when the noncompliances, individually or together, are significant but not pervasive.
The Report reveals that the Municipality of Comerío did not register or send to the Office of the Comptroller of Puerto Rico any of the collaborative agreements with the Municipal Enterprise Media Luna Recreational Area created by Ordinance 17 on May 15, 2013. This recreational complex is made up of the Media Luna Hotel, a space for a restaurant, a social events hall, gazebos, swimming pools, and green areas.
In this regard, the Municipality did not register a 2017 agreement for $200,000 as initial compensation from the insurance for the damages caused by Hurricane María, another 2018 agreement for $59,393 as insurance compensation for loss of business, and another 2019 agreement for $45,000 to complete the repairs of the facilities caused by Hurricane María at the municipal enterprise. In addition, it also did not send the 2019 transfer of the usufruct, control, and operation of the Casa Comerío in Bayamón.
As established by the law and regulations in force, no rendering or counter-rendering of services that is the object of a contract may be required until it has been sent or registered at the Office of the Comptroller.
The two-finding audit also notes that from 2017 to 2020 the municipal enterprise made purchases and repairs for $291,748, without the Municipality requiring it to obtain at least three quotes as ordered by law. This situation prevented free competition among the largest number of bidders and disrupted the processes.
The Report recommends to the Office of Management and Budget to ensure that the Municipality of Comerío complies with the Corrective Action Plan established by the Office of the Comptroller of Puerto Rico. This report covers the period from July 1, 2017, to December 31, 2020.
