The Office of the Comptroller of Puerto Rico issued a qualified opinion of the fiscal operations of the Municipality of Guayanilla. A qualified opinion is issued when the noncompliances, individually or together, are significant but not pervasive.
The Report reveals that the Municipality of Guayanilla submitted copies of the contracts and amendments to the Office of the Comptroller up to 90 days later than the time established by the applicable laws and regulations. From 2018 to 2021, the Municipality had granted eight contracts and 22 amendments for $14,997,788 to three companies for the administration of the Diagnosis and Treatment Center (CDT), and for project management services related to the emergencies following the hurricanes, earthquakes, and pandemic.
The one-finding audit notes that, as of June 27, 2022, 13 objections to four contracts and two amendments for $12,512,400 had not been corrected. The notice of objection occurs when the contract has some incorrect or incomplete information. The auditors found that up to three years had elapsed in some of the notices.
This situation does not allow the contracts and amendments to be accessible to the citizens as public documents, in the required time and with the correct information.
The Report comments that the Municipality paid $25,000 following a Confidential Settlement and Release Agreement in 2021, for a civil suit by a municipal employee against a municipal official for sexual harassment. This information was referred to the Office of Government Ethics on October 31, 2022, to take the appropriate action. This second and final report on Guayanilla covers the period from July 1, 2018 to June 30, 2022.
