The Office of the Comptroller of Puerto Rico issued a favorable opinion on the fiscal operations of the Federal Surplus Property Donation Program of the General Services Administration of the Government of Puerto Rico. The tests performed and the evidence revealed that the operations of the Program, the object of this Report, were carried out in all significant respects in accordance with the applicable law and regulations.

The audit examined compliance with the selection, transfer, existence, and use of donated federal property, as required by Act No. 28 of 1979, Act of the Operations Plan of Puerto Rico for the Federal Surplus Property Donation Program. Based on the work performed, we did not identify significant deficiencies related to internal controls.

However, the report comments that, as of March 12, 2024, Act No. 28 had not been updated. The recommendations of the General Services Administration (GSA), and in particular the forms used by the State Plan, remain under review by the General Services Administration. The head of the agency must certify and submit the revised State Plan to the administrator of the GSA for approval.

Until Act No. 28 is amended, the General Services Administration will not be able to charge for the services offered by the Program, which are currently financed entirely by internal allocations from the ASG's general budget.

From May 1, 2021 to April 30, 2023, the Program received approval to distribute 36,513 units of federal surplus property at an acquisition cost of $4,774,218.

The audit recommends that the Administrator continue with the processing of the proposed amendments to Act No. 28 so that they are sent and approved by the GSA. After final approval, she must request an amendment by petition to the Legislative Assembly.
