The Comptroller of Puerto Rico issues an adverse opinion on the acquisition and implementation of the Crime Information Warehouse (CIW), and on the controls established for the input and output of data of the Penal Records Certificate Issuance System (ANPE) and of the Firearms Administration System (FAS).
The Puerto Rico Police invested $4.4 million in 2010 for the acquisition and implementation of the CIW and $735,000 in 2012 for its maintenance and operation. The examination conducted revealed that since 2013, the CIW has not had up-to-date information from the databases of the Departments of Correction, Justice, and Transportation and Public Works. In addition, as of October 20, 2014, the CIW's Statistics module was not being used. These situations did not allow the Police to obtain the maximum benefit from the $5.1 million invested, nor did the Police have the statistical information necessary to investigate the offenses. On the contrary, the Police worked the statistics in the SAEC+ System created in 2002 and in an Excel spreadsheet.
The six-finding Report points out that the information contained in the FAS is incomplete and unreliable. For example, the firearms database did not indicate the model of the weapons in 60,625 records, and the licenses database indicated as active –after the 5-year term of a license– some 12,438 records for which up to eight years had elapsed after the term. Our auditors also identified deficiencies with the process of notifying the expiration of firearms licenses.
The audit reveals that as of 2014 some 15,000 sentences for misdemeanors had not been recorded in the ANPE System, and that as of 2015 the certificates issued by the Police did not include offenses committed in local, state, or federal jurisdictions of the United States. Likewise, the ANPE System had not incorporated some articles of the 2004 Penal Code and the articles of the 2012 Penal Code. These situations affect the integrity and reliability of the System that issues Penal Records Certificates.
