Audit Report TI-22-08, Department of Consumer Affairs – Office of Information Technology

The Office of the Comptroller of Puerto Rico issued a qualified opinion of the operations of the computerized information systems of the Department of Consumer Affairs (DACO) related to the Risk Analysis and the Plan for Continuity of Operations and Contingency in Emerging Situations, and with the information on the complaints in the Integrated Consumer Affairs System (SIAC). A qualified opinion is issued when noncompliances, individually or together, are significant but not pervasive.

The one-finding Report reveals that, as of August 16, 2021, the SIAC did not contain an information field that would allow identifying that the complainant is elderly, that they are 67 years of age or older. This information is necessary to comply with Act 147-2019, the Act of Expedited Administrative Processes for Elderly Persons.

This act, approved on September 27, 2019, establishes as public policy that it must be guaranteed that the administrative procedures of an elderly person are carried out in a fast, fair and economical manner. The complaint must be addressed within 30 days of its filing, and if submitted to an adjudicative procedure before an agency, it must be resolved within a strict term of 90 days from its filing. The report covers the period from February 16 to October 29, 2021.
