(San Juan-PR) – The Comptroller of Puerto Rico, Yesmín M. Valdivieso, made a call to the contractors of the Government of Puerto Rico, public instrumentalities, and municipalities to follow the rules of government contracting. The campaign titled “Avoiding findings is in your hands” emphasizes that every contract must be in writing, signed by all parties, have prospective effect, and be registered and submitted to the Contracts Registry of the Office of the Comptroller of Puerto Rico (OCPR).
“The regulations of government contracting are very strict and specific since they involve public funds. We recommend that you make sure the contract complies with all the requirements of law, the regulations, and the interpretive jurisprudence to avoid irregularities,” expressed the Comptroller.
In addition, it is a requirement that the contract be registered in the Contracts Registry of the OCPR before beginning to render services. In this regard, the contractor must receive an email expressly indicating that their contract is registered. On the other hand, amendments to government contracts must be made during the term of the contract, not after it has expired.
For years, the most common findings of the audits refer to payments made outside the contract, services rendered before or after the term of the contract, lack of clauses, or registering and submitting the contract to the OCPR registry late. “Public contracting represents a significant proportion of the government budget. For this reason, contractors have the responsibility to ensure compliance with all applicable legal standards to avoid a finding or a recovery recommendation,” the Comptroller of Puerto Rico indicated.
