The Office of the Comptroller of Puerto Rico published the result of an investigation into the attendance of two employees of the Carolina region of the Public Buildings Authority (AEP), who performed private work during business hours. The investigation observed that the project conservation and maintenance supervisor and the warehouse keeper II worked at a company providing maintenance and repair services for roofs and general construction, which in turn provided services through a company contracted by the Tu Hogar Renace Program of the Department of Housing of Puerto Rico.
The investigation revealed that, for the evaluated period from April 30, 2018 to August 19, 2018, the conservation and maintenance supervisor worked 41 days (36 business days) and the warehouse keeper 27 days (20 business days), in the Tu Hogar Renace Program. For said work the Company incorporated by the conservation and maintenance supervisor received $28,073.
However, according to the certified attendance sheets of Public Buildings, the supervisor had recorded 18 days of work on regular schedule and 18 days charged to accrued leave; and the warehouse keeper had recorded 19 days of work on regular schedule and one charged to his leave.
For these facts, the supervisor may have committed the crimes of ideological falsehood, filing of false documents or data, possession and transfer of falsified documents, aggravated illegal appropriation, illicit use of work or services, breach of duty, and violations of Act 1-2012, Government Ethics Act.
The warehouse keeper, for his part, may have committed the crimes of filing false data, possession and transfer of falsified documents, aggravated illegal appropriation, illicit use of work, breach of duty, and violations of Act 1-2012.
These situations were referred on November 30, 2021, to the Secretary of Justice and to the executive director of the Office of Government Ethics so that they may carry out the processes they deem pertinent.
In addition, the investigation revealed that the Company incorporated by the AEP's conservation and maintenance supervisor in 2017 is not registered as an employer at the Department of Labor and Human Resources nor has it filed quarterly returns. The Company also does not appear in the Registry of Municipal Patents of Industry, Commerce, Services and Integrated Information System of the Municipality of Carolina.
