The Office of the Comptroller of Puerto Rico published the result of the investigation of a complaint related to the attendance of a typist clerk employee assigned to the Office of Medical Emergencies of the Municipality of Yabucoa. The complaint alleges that, during business hours, she studied at an educational institution in Yabucoa and performed a study internship at a private laboratory in the Municipality of Las Piedras.
The investigation revealed that the Municipality's attendance sheets did not record absences or notations of authorized leave during a period of 37 days that she worked during business hours at the private laboratory. This represented a payment of $583.55 in salary.
The laboratory's human resources advisor certified that the clerk performed her study internship from October 6 to November 30, 2020 and was hired as a billing assistant effective December 1, 2020. The educational institution's legal advisor presented the employee's class schedule and internship sheets.
This situation, contrary to Act 107-2020, Municipal Code of Puerto Rico and to Act 146-2012, Penal Code of Puerto Rico, was referred to the Secretary of Justice and to the executive director of the Office of Government Ethics of Puerto Rico on December 9, 2021, so that they may carry out the processes they deem pertinent.
The investigation also concludes that the supervisor did not comply with his responsibility to ensure that the clerk complied with the regulations applicable to attendance recording, nor did he document the reasons for not recording her workday in the mechanized system. This situation is contrary to the Workday Regulation and some violation of the Penal Code may have been constituted.
