The Office of the Comptroller of Puerto Rico published the result of the investigation into a referral from its Municipal Audits Division regarding alleged irregularities related to two contracts for design services and the preparation of plans in Luquillo.
The investigation revealed that the Municipality contracted a person to perform the services of plan design and interior decoration without holding the required licenses. Although on the social network LinkedIn the contractor describes herself as president of an interior design company, she does not appear in the records of the Association of Interior Designers-Decorators of Puerto Rico, nor is she listed in Examining Boards of the Department of State.
To that effect, the two contracts signed in June and November 2014, for a total of $9,300, are void by failing to comply with the requirements established in current laws.
In addition, the Municipality acted contrary to Act 237-2004, on the uniform parameters in the processes of contracting professional and consulting services, since they paid invoices for services rendered outside the validity of the contracts.
The Report also concludes that the mayor failed to comply with the provisions of Act 81-1991, of Autonomous Municipalities, because he contracted a person who is not authorized to practice as an interior decorator-designer in Puerto Rico and incorrectly paid the invoices of the second contract.
The results of this investigation were referred on May 11, 2021, to the attention of the Department of Justice, and of the Examining Board and the Association of Interior Designers-Decorators of Puerto Rico.
