The Comptroller of Puerto Rico publishes the result of the investigation of a complaint related to the use of public property of the Municipality of Guayanilla. The complaint alleges that in August 2017 a citizen carried out work on his residence with heavy equipment owned by the Municipality.
The investigation carried out by the Office of Complaints and Fiscal Intelligence revealed that on August 15, 2017 a loader and a municipal employee were used to perform earth crust extraction and tree removal work on the citizen's private property on a parcel in the Magas Abajo ward in Guayanilla. This person did not have a written contract with the municipality, nor had he paid for these services as provided by Ordinance 45.
This situation is aggravated since the citizen did not have the permits from the Permit Management Office (OGPe) to carry out the earth crust removal work, nor did the Municipality require them of him. Not requiring the permits exposes the Municipality to unnecessary lawsuits and to sanctions by OGPe, in addition to failing to comply with Act 81-1991, on Autonomous Municipalities.
The investigation recommends that the Internal Audit Office of Guayanilla carry out an investigation and determine whether recovery is appropriate for the use of municipal personnel and property for the private benefit of a private citizen without complying with the established requirements, among other things.
