The Office of the Comptroller of Puerto Rico issued a Special Report on compliance with Act 136-2003 by 274 government entities. This act has the purpose of ensuring that the public services that have been contracted with private entities respond to the needs and interests of citizens through the scrutiny of their operations.
The Report reveals that 164 entities had not submitted to the Office of the Comptroller the Certification of Compliance with Act 136-2003 in one or several of the fiscal years from 2013 to 2017 (see Exhibit 2 of the Report). This figure constitutes 60% noncompliance.
In addition, 169 entities, 62%, submitted the Annual Report on the Status of Privatizations and the Certification with delays, in some cases, of up to more than four years (see Exhibit 3 of the Report).
These situations deprive the Office of the Comptroller of having such information available for the benefit of citizens as provided by law.
The Office of the Comptroller issues every year a circular letter as a reminder to the principal officers about their responsibility to submit such information. In addition, the Office created and established an application through which the required forms must be submitted. In this regard, our examination revealed that seven entities, 3%, submitted the information, but not through the correct method via the application.
