(August 26, 2022) Comptroller Yesmín Valdivieso sent a circular letter to mayors, presidents of the municipal legislatures, security commissioners of the municipal police forces and municipal internal auditors on the limitations on the actions of municipal police officers.
Valdivieso explained that the purpose of the communication is to provide guidance on the actions of police officers in compliance with the Municipal Code.
“In our audits we have detected cases in which the Municipal Police has been used to provide surveillance or protection services to private persons, municipal officials and to transport private property in various activities outside the jurisdiction of the municipalities concerned,” the Comptroller states.
She added that the Municipal Code clearly and expressly prohibits and penalizes the participation of members of the Municipal Police in partisan political activities while they are in the exercise of their functions.
Valdivieso cited several articles contained in the Municipal Code where the violations that could be considered of a serious nature are established and may entail a punishment of permanent expulsion from the Municipal Police, demotion or suspension without pay, for a period not exceeding three months.
